Rights, Terms of Use, and Terms of Sale

These Rights, Terms of Use, and Terms of Sale govern access to and use of the SolaceCompass public website, progressive web app features, public library pages, free resources, protected membership areas, digital downloads, direct purchases, license transactions, and related SolaceCompass content and services.

By accessing the website, creating an account, joining a membership area, downloading a resource, purchasing a product, accepting a license, or using SolaceCompass content, you agree to these terms. If you do not agree, do not use the site or services.

1. Who we are

“SolaceCompass,” “we,” “us,” and “our” refer to SolaceCompass and the legal person or entity operating the SolaceCompass website and related digital services.

These terms apply to both:

Additional license terms, order terms, membership rules, or product-specific restrictions may apply to particular resources or purchases.

3. Educational self-support only

SolaceCompass provides educational, creative, reflective, grounding-focused, and self-support resources. The content is not medical advice, mental-health treatment, diagnosis, crisis care, psychotherapy, or a substitute for care from a qualified professional.

You are responsible for your own decisions and for seeking appropriate professional, medical, legal, or emergency help when needed.

4. Emergency and crisis notice

If you feel at risk of harming yourself or someone else, feel unable to stay safe, are being harmed, or are experiencing an emergency, seek immediate help from local emergency services, a crisis line, or a qualified professional. SolaceCompass is not an emergency service and does not monitor messages for emergencies.

5. No guarantee of outcomes

SolaceCompass resources may support reflection, creativity, grounding, journaling, education, or personal steadiness. We do not promise that any book, worksheet, coloring page, printable, audio, story, message, soundscape, member resource, image, or exercise will diagnose, treat, cure, prevent, reduce symptoms, or produce any specific result.

6. Accounts and membership

If you create an account or join a membership section, you must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized access.

You may not share your login, give others access to member-only content, scrape the library, bypass access controls, or use another person's account.

Membership access is personal to the account holder unless a written organization or team license expressly says otherwise. Membership content may be viewed and used only within the permissions stated on the member page, product page, license, or download instructions.

We may suspend or terminate membership access if we reasonably believe there has been nonpayment, security risk, account sharing, abuse, rights infringement, license breach, or violation of these terms.

7. Subscriptions and renewals

If SolaceCompass offers paid recurring membership or subscription plans, the checkout page will identify the price, billing frequency, renewal terms, and cancellation method. Unless the checkout page says otherwise, subscriptions renew automatically until cancelled.

Cancellation stops future renewal charges but does not automatically create a refund for past charges, current billing periods, already delivered digital content, or previously accessed member resources, except where required by law or expressly agreed by SolaceCompass in writing.

8. Purchases, digital delivery, and license records

Some SolaceCompass products may be sold directly through SolaceCompass. Others may be sold through external marketplaces or publishing partners. Product pages, checkout pages, receipts, license certificates, and download pages may include additional terms.

For direct digital purchases, access may begin immediately after payment or account verification. You are responsible for downloading, storing, and backing up your files unless a product page expressly provides ongoing access.

Delivery of a file does not transfer ownership of SolaceCompass content. It grants only the limited use rights stated in the applicable license or product terms.

9. Image assets and commercial-image license terms

SolaceCompass image assets, coloring pages, printables, digital image packs, practitioner resources, organization resources, preview files, clean files, and related commercial image products may be governed by separate image-license terms.

The SolaceCompass General Image License Terms are available at https://www.solacecompass.com/license-terms.

If you purchase, download, print, copy, access, or use a licensed image asset after being presented with those license terms, you are bound by the applicable image-license terms, schedule, order record, receipt, or license certificate.

If these website terms conflict with the SolaceCompass General Image License Terms for a licensed image asset, the applicable image-license terms control for that asset and license transaction.

10. Refund policy

All SolaceCompass direct digital purchases, downloads, memberships, subscriptions, licenses, and digital resources are sold on a no-refund basis unless SolaceCompass expressly agrees otherwise in writing or a refund is required by applicable law.

This no-refund policy applies because digital files, member resources, licenses, and downloadable content may be accessed, copied, printed, saved, or used immediately after delivery.

SolaceCompass may, in its sole discretion and without creating any future obligation, consider edge cases such as duplicate accidental purchases, verified technical delivery failures that SolaceCompass cannot reasonably fix, clearly erroneous charges, or other specially agreed circumstances. Any exception must be expressly approved by SolaceCompass.

Refunds, credits, replacements, or accommodations offered in one case do not create a right to the same outcome in another case.

Nothing in this section limits non-waivable rights that apply under mandatory consumer law.

11. External marketplace purchases

When you purchase through Amazon, Etsy, Gumroad, TikTok Shop, Payhip, app stores, payment processors, publishers, or other external platforms, the purchase, payment, taxes, delivery, account support, cancellation, chargeback, and refund process may be governed by that third party's terms and policies. SolaceCompass may not be able to override those platform rules.

A marketplace sale does not give you broader rights in SolaceCompass content than the applicable SolaceCompass license allows.

12. Prices, taxes, and payment

Prices, taxes, currency, billing terms, and delivery terms will be shown at checkout or by the third-party platform handling the sale. You are responsible for applicable taxes, payment-provider charges, foreign-exchange charges, and platform fees unless the checkout expressly says otherwise.

SolaceCompass may change prices, products, membership tiers, license offerings, bundles, discounts, or availability prospectively. Changes do not alter completed transactions unless expressly stated or legally required.

13. Intellectual property

Unless otherwise stated, SolaceCompass names, trademarks, logos, text, page layouts, designs, images, illustrations, coloring pages, line art, PDFs, audio, videos, digital files, metadata, packaging, prompts, descriptions, written materials, software, member resources, and brand materials are owned by SolaceCompass or its licensors and are protected by copyright, trademark, contract, and other rights.

You receive no ownership interest in SolaceCompass content. Any rights you receive are limited, conditional, non-exclusive, and governed by these terms, the applicable product terms, and any applicable license agreement.

14. Public-site personal viewing license

You may view public website pages for personal, non-commercial purposes. You may not copy, scrape, reproduce, redistribute, repost, sell, train models on, extract, host, or commercially exploit public-site content unless SolaceCompass gives written permission or the applicable content is expressly labeled for that use.

15. Freebies, samples, and member resources

Free resources, samples, previews, worksheets, printables, downloads, and member resources are licensed, not sold. They may be used only under the license or instructions provided with the resource.

Unless a resource expressly says otherwise, you may not redistribute it, upload it, sell it, include it in another product, use it with clients, use it organization-wide, submit it to stock platforms, or use it for AI or machine-learning purposes.

16. AI, scraping, and data-use restrictions

You may not use SolaceCompass content, including public-site content, member content, images, audio, files, written materials, metadata, or licensed assets, to create, train, fine-tune, test, evaluate, improve, benchmark, or validate artificial-intelligence or machine-learning systems.

You may not scrape, crawl, bulk download, extract, build datasets from, create embeddings from, or create training corpora from SolaceCompass content unless SolaceCompass has expressly authorized that use in a signed written agreement.

You may not use SolaceCompass images as reference images, control images, conditioning images, prompts, style references, or similar inputs to generate substantially similar commercial assets.

18. User submissions and feedback

If you send suggestions, comments, testimonials, reviews, survey responses, ideas, corrections, or other submissions, you represent that you have the right to send them and that they do not violate another person's rights or privacy.

Unless we separately agree otherwise, you grant SolaceCompass a non-exclusive, worldwide, royalty-free license to use feedback and non-confidential suggestions to improve, operate, promote, and document SolaceCompass products and services. Do not send confidential information or private health information through ordinary feedback channels.

19. Third-party links, tools, and platforms

SolaceCompass may link to or integrate with third-party websites, marketplaces, payment processors, email tools, analytics tools, hosting providers, social platforms, publishers, or other services. We are not responsible for third-party content, availability, policies, fees, security, delivery, refunds, or account decisions.

20. Affiliate and partner links

Some links may be affiliate, marketplace, referral, or partner links. If SolaceCompass receives a commission or other benefit from a link, we will aim to disclose that relationship clearly and honestly where required or appropriate.

21. Availability and changes

We may change, suspend, remove, replace, update, or discontinue any page, product, membership feature, download, freebie, link, bundle, license offering, or service at any time. We are not obligated to keep all products or resources available indefinitely.

We may update these terms prospectively. The “Updated” date above will change when these terms are revised. Continued use after an update means you accept the updated terms for future use, subject to non-waivable rights and any separate agreement governing already-purchased licenses.

22. Disclaimers

To the fullest extent permitted by law, SolaceCompass content and services are provided “as is” and “as available.” We do not warrant that the site will be uninterrupted, error-free, secure, compatible with every device, clinically effective, suitable for your circumstances, or available forever.

We do not warrant that every resource will meet your expectations or that any particular outcome will occur.

23. Limitation of liability

To the fullest extent permitted by law, SolaceCompass is not liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for lost profits, lost revenue, lost data, lost goodwill, emotional distress, professional consequences, or business interruption arising from the website, membership, products, downloads, licenses, or content.

To the fullest extent permitted by law, SolaceCompass's aggregate liability for any direct claim relating to the site, membership, direct purchase, or digital product will not exceed the amount you paid to SolaceCompass for the specific product or service giving rise to the claim during the twelve months before the claim, or the minimum amount that applicable law does not permit us to exclude or limit.

Some laws do not allow certain exclusions or limitations. In that case, the limitation applies to the maximum extent permitted by law.

24. Indemnity for misuse

If you use SolaceCompass content for business, practitioner, organization, commercial, professional, or non-personal purposes, you agree to defend, indemnify, and hold SolaceCompass harmless from claims, losses, liabilities, damages, costs, and reasonable legal fees arising from your misuse, unlawful conduct, professional services, unauthorized claims, license breach, privacy violation, or use outside the permitted scope, to the extent allowed by law.

Consumer indemnity obligations apply only to the extent permitted by applicable consumer law.

25. Suspension and termination

We may suspend or terminate access to the site, membership areas, downloads, accounts, or licenses if we reasonably believe you violated these terms, violated a license, created legal or security risk, failed to pay, shared access improperly, misused files, or engaged in fraud, abuse, scraping, or rights infringement.

Termination does not eliminate obligations that should reasonably survive, including ownership, license restrictions, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions.

26. Governing law and forum

Unless a separate written agreement states otherwise, these terms are governed by the laws of British Columbia, Canada, excluding conflict-of-laws rules, subject to mandatory consumer rights that cannot be waived.

Subject to mandatory consumer rights and any court jurisdiction that cannot lawfully be excluded, disputes will be brought in British Columbia.

27. Mandatory rights

Nothing in these terms excludes, limits, or waives rights or remedies that cannot lawfully be excluded, limited, or waived, including mandatory consumer, privacy, and digital-content rights that may apply in your location.
